Copyright review

The image currently on this page, File:Icadyptes salasi00.jpg was uploaded by a user who was unsure of the copyright status. The image was part of the following release from North Carolina State University:

  • "March of the Giant Penguins: Fossils Reveal Early Penguins Reaching 5 Ft. Tall Lived Near the Equator During One of Earth's Warmest Periods". North Carolina State University. 2007-06-25. Retrieved 2007-06-29.

My suspicion is that the material does not qualify as fair use, although I've never encountered fair-use with this sort of article, so I'm unsure and wanted to seek a second opinion. Also, I wondered if perhaps the copyright status of images in NC State news releases is already established and I simply don't know. Basically, wanted to double check before having an image that improves an article removed. --JayHenry 16:14, 29 June 2007 (UTC)
