It's not clear that this photo from the 1970s is really the uploader's own work. I'm not saying it isn't, but hopefully this will come out in discussion. Non-free photo of deceased British politician Jeremy Thorpe. File has a non-free use rationale for the article about Thorpe and was uploaded on 5 December 2014, the day after Thorpe died, probably based upon of No. 10 of WP:NFCI which says "Pictures of deceased persons, in articles about that person, provided that ever obtaining a free close substitute is not reasonably likely" may be allowed. The amount of of time which has passed since a person has died needed to demonstrate that WP:NFCC#1 can be satisfied is not clearly stated, and this is probably something which needs to be further discussed; however, it appears that a freely licensed version which serves that same encyclopedic purpose was created on 19 June 2016 as File:Jeremy Thorpe cropped.jpg. Assuming the Commons' licensing is problem free, it seems that the non-free file now no longer satisfies NFCC#1. So, my opinion is that it should be deleted, unless the difference in quality between the two images is significant enough to warrant keeping the non-free. The non-free file was also being used in United Kingdom general election, 1970 ‎, United Kingdom general election, February 1974 and United Kingdom general election, October 1974. It had been replaced by the freely licensed file, but it was re-added to the elections until I replaced it with the freely licensed version once again. So, if the non-free is to be kept, its usage should be limited to "John Thorpe" and this should be made clear on the file's talk page, etc. -- Marchjuly (talk) 22:57, 2 July 2016 (UTC)[reply]

With regard to NFCC#1, you will not find an image of Thorpe that dates back before 1923, the relevant UK date. Any post 1922 image needs to come with far more information to justify its free status. The cropped colour image of Jeremy Thorpe is taken from an image that is a grab of an original image that was uploaded to the internet without proper sourcing or any crediting. In addition to the photographer not being known, the date of creation or any publication date are not known either. The image in Wikimedia Commons, is claimed to be free on the basis of it appearing on Flickr, which in itself should not be sufficient to justify free status in Commons. I consider this image's status of free to be highly questionable and its maintenance as an image on Wikimedia Commons to be shaky. The non-free image from 1965 on the other hand is well identified and sourced. If the 1965 image were to be replaced by another image, that image would need to be unquestionably free, and the cropped image in my view comes nowhere near satisfying its claimed free status. Also, that if it were to be replaced by a free image, that image would need to be of sufficient quality to be able to identify the person in question. @Graemp: Both File:Jeremy Thorpe cropped.jpg and File:Jeremy Thorpe.jpg were cropped from File:Whitehall (15420756838).jpg which was verified to have been released under a CC Generic 2.0 free license. CC Generic 2.0 is one of the licenses accepted for Flickr files per c:COM:FLICKR and the file's licensing was reviewed in November 2015 and confirmed to be OK. If the consensus at Commons is that the original file's licensing in OK, then WP:NFCC#1 would seem to apply. As for the "ability to do the job", all that is needed is to serve the same encyclopedic purpose. Clearly these files exist on Commons because there has been a lack of user interface at Commons to establish if the uploader to Commons has done any more than take at face value the questionable license assigned to the un-cropped image by the person who uploaded it to Flickr. This is a frequent problem with images uploaded to Commons. My view is that wikipedia users such as yourself who review images on wikipedia by trawling Commons need to be certain that an image on Commons which is claimed to be free, is actually free. So I think your next step is to deal with the images on Commons. I appreciate that you may think that to have to do this sucks, but I think that it comes with the territory for any wikipedia user who reviews wikipedia images with reference to commons images. I agree with you that lots of files are inappropriately uploaded to Commons, but I don't necessarily think it "sucks" to ask for clarification at the Commons Village Pump and have done so at c:COM:VP/C#File:Whitehall (15420756838).jpg. From my limited experience of the workings of those on Commons is that they can sometimes be unrealistically demanding on criteria on free status while usually being very slapdash with their monitoring of files they host. This is a clear case of total lack of evidence to justify free status and Commons should not hide behind a third party's unproven licensing to justify keeping an image. Debating here at FFD whether the file's licensing is correct is not going to lead Commons to deleting it. So, if you feel it is incorrect, then you can comment at the Commons VP thread or nominate the file for deletion yourself via COM:DR and see if others agree with you. • Update: The Commons file has been deleted as a copyvio, so there are no more WP:NFCC#1 concerns. Non-free use seems fine in Jeremy Thorpe; however, I believe non-free use should be limited to that article only and not allowed in United Kingdom general election, 1970, United Kingdom general election, February 1974, and United Kingdom general election, October 1974, where the file was also being used until removed for not having the required non-free use rationale, per WP:NFCC#8 for reasons similar to those given in Wikipedia:Files for discussion/2016 March 30#File:Clement Davies c1955.jpg unless better justification for non-free use and a proper non-free use rationale is provided for each additional use. -- Marchjuly (talk) 13:02, 15 July 2016 (UTC)[reply]
